Terms of Use
Last updated: September 2026
1. Agreement to Terms
These Terms of Use (“Terms”) govern your access to and use of ignite-perform.com (the “Site”) and the coaching services, digital resources, and related offerings provided by Ignite Performance Consulting, LLC (“Ignite Performance,” “we,” “us,” or “our”). By visiting the Site, submitting a form, downloading a resource, or enrolling in coaching, you agree to these Terms. If you don’t agree, please don’t use the Site or our services.
If you are enrolling a minor in coaching or submitting a minor’s information through our forms, see Section 4 — your acceptance of these Terms on their behalf is required.
2. Who We Are and What We Offer
Ignite Performance provides mental performance coaching for athletes, parents, and teams, delivered through one-on-one sessions, team workshops, and related digital resources (worksheets, guides, and similar materials). Our coaching focuses on mindset, confidence, resilience, discipline, and goal-setting.
Our coaching is not medical, psychiatric, or mental health treatment, and it is not a substitute for care from a licensed medical or mental health professional. If you or your athlete is experiencing a mental health crisis, please contact a licensed provider or emergency services rather than relying on our coaching.
The free resources on this Site are educational and informational only. Browsing the Site, downloading a resource, or exchanging emails with us does not create a coaching relationship — that begins only once you’ve formally enrolled in a paid program. Results from applying free content on your own may differ from what individualized coaching can offer.
3. Eligibility
Our coaching services are for athletes aged 13 and older. We do not offer coaching to, or knowingly collect information about, children under 13. You must be at least 18 years old to enroll in coaching or purchase services on your own behalf, or to accept these Terms on behalf of a minor athlete aged 13–17. By using the Site or our services, you represent that you meet this requirement or that you are a parent or legal guardian accepting these Terms on a minor’s behalf.
4. Minors and Parental Consent
Many of our athlete clients are between 13 and 17 years old. Where that’s the case:
- A parent or legal guardian must review and accept these Terms and our Privacy Policy before the athlete begins coaching or has any personal information collected through our forms.
- The parent or guardian submitting the athlete’s information confirms they have the authority to do so and consents to our collection and use of that information as described in our Privacy Policy.
- We rely on the parent or guardian to ensure the information provided about the minor is accurate.
5. Accounts, Forms, and Accurate Information
When you submit a form (intake, waitlist, resource download, or otherwise), you agree to provide accurate, current information and to update it if it changes. We reserve the right to decline or discontinue service if information provided is false or misleading.
6. Payment, Enrollment, and Refunds
Pricing and payment terms for coaching are provided at the time of enrollment. Card payments are processed through PayPal; by enrolling, you also agree to PayPal’s applicable terms for whatever payment method you use there. Refunds are governed by our Money-Back Guarantee, which takes precedence over any general refund expectation not stated there. Enrolling in a paid program constitutes agreement to the payment terms presented at checkout or in your enrollment agreement.
To keep the guarantee fair and prevent misuse, refunds are limited to one per customer or family, regardless of how many programs or sessions are purchased over time. If you receive a refund, your license to use any materials provided as part of that program (worksheets, guides, recorded content, or similar) ends immediately, and you agree to stop using them and delete or destroy any copies you’ve downloaded.
7. Results, Testimonials, and Content Accuracy
The testimonials, case studies, and results referenced on this Site reflect the genuine, honestly reported experiences of real clients, shared with their permission. We do not fabricate testimonials or alter their substance, and any identifying details (such as a name, sport, or team) are accurate to our knowledge at the time of publication.
Coaching outcomes depend on many factors specific to each athlete, including effort, consistency, and circumstances outside our control. While we’re proud of the outcomes described in testimonials and case studies on this Site, we do not guarantee specific results, including performance improvements, confidence gains, scholarship offers, or competitive outcomes. Testimonials reflect individual experiences and are not a promise of similar results for every athlete. Prior results do not guarantee a similar outcome.
We aim for accuracy in everything we publish, but the Site and our free resources may contain errors or become outdated. You’re responsible for how you use any information or resource we provide, and for checking anything important with us or with a qualified professional before acting on it.
8. Intellectual Property
All content on the Site — including text, graphics, logos, worksheets, guides, and coaching materials we provide — is owned by Ignite Performance or licensed to us, and is protected by copyright and other intellectual property laws. You may use downloaded resources for personal or family use. You may not reproduce, redistribute, resell, or publish our content or coaching materials without our written permission.
9. User Submissions
If you submit content to us — a testimonial, a comment, a response to one of our forms, or anything else you share with the expectation we might use it — you grant Ignite Performance a non-exclusive, royalty-free, worldwide license to use, reproduce, edit, and publish that content in connection with our services and marketing (for example, featuring a testimonial on the Site or in social media). We won’t use identifying details from a minor’s submission without a parent or guardian’s consent. You confirm that anything you submit is your own, doesn’t infringe on anyone else’s rights, and isn’t false, defamatory, or unlawful. We’re not obligated to use or pay for any submission, and we may remove submitted content (such as a comment) at our discretion.
10. Acceptable Use
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorized access to the Site, our systems, or other users’ information.
- Submit false information, impersonate another person, or misrepresent your relationship to a minor when submitting their information.
- Scrape, copy, or reuse Site content beyond what these Terms permit.
- Post or transmit anything defamatory, harassing, obscene, or that infringes someone else’s rights (including through comments or form submissions).
11. Third-Party Links and Services
The Site may link to or use third-party services (for example, scheduling, email delivery, or payment processing tools). We aren’t responsible for the content, policies, or practices of third-party sites or services, and your use of them is governed by their own terms.
12. Disclaimer of Warranties
The Site and our services are provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law. We don’t warrant that the Site will be uninterrupted, error-free, or secure.
13. Limitation of Liability
To the fullest extent permitted by law, Ignite Performance Consulting, LLC and its coaches, employees, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our services, even if we’ve been advised of the possibility of such damages. Nothing in these Terms is intended to limit liability where such a limitation isn’t permitted by law.
14. Indemnification
You agree to indemnify and hold harmless Ignite Performance Consulting, LLC from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Site or our services.
15. No Employment, Partnership, or Agency Relationship
Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between you and Ignite Performance. Coaches, contractors, and clients act independently, and no one is authorized to make commitments on behalf of Ignite Performance except as expressly agreed in writing.
16. Termination
We may suspend or terminate your access to the Site or our services at our discretion, including for violation of these Terms. You may stop using the Site or discontinue services at any time, subject to any enrollment or payment commitments already in place.
17. Changes to These Terms
We may update these Terms from time to time. The “last updated” date above reflects the most recent revision. Continued use of the Site or our services after changes are posted constitutes acceptance of the updated Terms.
18. Governing Law
These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-law principles.
19. Arbitration and Class Action Waiver
Any dispute arising out of or relating to these Terms, the Site, or our services will be resolved through binding arbitration rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. Arbitration will take place in Missouri, or another location the parties mutually agree on, under the rules of a recognized arbitration provider.
You and Ignite Performance each waive the right to bring claims as part of a class action, class arbitration, or other representative proceeding. Disputes will be resolved only on an individual basis.
This section does not limit either party’s right to seek injunctive relief in court to protect intellectual property rights.
20. Entire Agreement
These Terms, together with our Privacy Policy and Money-Back Guarantee, make up the entire agreement between you and Ignite Performance regarding your use of the Site and our services, and supersede any prior agreements or understandings on the same subject.
21. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
